Acceptance of terms
Welcome to fkra|فكرة ("fkra|فكرة", "the Platform", "we", "us", or "our"), accessible at www.fkra.ai. By creating an account or otherwise accessing or using fkra|فكرة, you ("you" or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Platform.
If you use fkra|فكرة on behalf of an organization, you represent that you have authority to bind that organization to these Terms. Where your organization has a separate written agreement with fkra|فكرة (such as a master services agreement or order form), that agreement prevails over these Terms to the extent they conflict.
Description of the service
fkra|فكرة is an AI-powered learning platform for organizations. Its services include, among others:
- Course generation — learning modules generated from your organization's source documents, reviewed and approved by its authors.
- Learning paths and modules — structured curricula with stages, prerequisites, and sequencing.
- Assessments and certificates — quizzes, assessment attempts, and completion certificates.
- AI learning copilot — conversational assistance for learners inside their content.
- Media studio — video and audio enriched with transcripts, chapters, and interactive checkpoints.
- Analytics and administration — progress dashboards, enrollment management, and workspace administration tools.
The Platform is offered as a managed private SaaS, a white-label deployment, or an on-premise installation. Feature availability may vary by plan and deployment model, and we may improve or modify features over time.
User accounts
To access most features you must have an account, which may be created by you or provisioned by your organization. You agree to:
- Provide accurate, current, and complete registration information.
- Keep your account information accurate and up to date.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activity that occurs under your account.
- Notify us promptly at support@fkra.ai if you suspect unauthorized use of your account.
You may not share your credentials or use another person's account without permission. Accounts provisioned by an organization may also be administered — including suspended or removed — by that organization.
Plans and orders
fkra|فكرة is sold on a sales-led basis. Access, seats, fees, term, and renewal are set out in the agreement or order between fkra|فكرة and your organization. There are no self-serve purchases on the Platform.
We may offer trial or evaluation access at our discretion; such access may be limited in scope and duration and may be withdrawn at any time.
User content
You and your organization may upload documents, media, and other materials, and create content on the Platform ("User Content"). You retain ownership of your User Content, subject to the following:
- License — you grant fkra|فكرة a worldwide, non-exclusive, royalty-free license to host, process, display, and reproduce your User Content solely to operate and improve the Platform.
- AI processing — content submitted to AI features may be processed by third-party AI model providers, as described in our Privacy Policy. Do not submit content you are not authorized to share.
- Visibility — content you post in shared spaces, such as discussions, is visible to other members of your workspace and is subject to our Guidelines.
- Responsibility — you are solely responsible for the legality, reliability, and appropriateness of your User Content.
Prohibited uses
You agree not to use fkra|فكرة to:
- Pursue any unlawful purpose or violate any applicable law or regulation.
- Infringe the intellectual property rights of fkra|فكرة or any third party.
- Harass, abuse, defame, or discriminate against any person or group.
- Upload or transmit viruses, malware, or any other malicious code.
- Attempt to gain unauthorized access to the Platform, other accounts, or connected systems.
- Use automated scripts, bots, or scrapers to access the Platform without prior written consent.
- Compromise assessment integrity — including sharing assessment content or answers, or completing assessments on another person's behalf.
- Resell, sublicense, or commercially redistribute the Platform or its outputs without authorization.
- Generate content that is illegal, harmful, or abusive through our AI features.
AI services disclaimer
fkra|فكرة uses artificial intelligence models to provide several features. You acknowledge and agree that:
- No guarantee of accuracy — AI-generated content may contain errors, inaccuracies, or biases. Review and verify AI output before relying on it.
- Not professional advice — AI outputs do not constitute legal, medical, financial, or other professional advice.
- Availability — AI features depend on third-party providers and may be temporarily unavailable due to outages, rate limits, or maintenance.
- Model changes — we may update or replace the underlying models at any time, which may affect the style or quality of outputs.
Intellectual property
The fkra|فكرة platform — including its name, logo, design, source code, and all original content — is owned by fkra|فكرة and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, create derivative works of, or exploit any part of the Platform except as expressly permitted by these Terms or a separate written agreement.
Certain components of the Platform may include open-source software; your use of those components is governed by their respective licenses.
Privacy
Your use of fkra|فكرة is also governed by our Privacy Policy, which describes how we collect, use, store, and share personal information.
Disclaimer of warranties
The Platform and all services and content provided through it are offered on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by law, fkra|فكرة disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or completely secure.
Limitation of liability
To the maximum extent permitted by law, fkra|فكرة and its officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses.
In no event shall the total aggregate liability of fkra|فكرة exceed the amounts paid to fkra|فكرة for the service in the twelve (12) months preceding the event giving rise to the liability, or one hundred United States dollars (US $100), whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless fkra|فكرة and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Platform, your violation of these Terms, your User Content, or your violation of any third-party rights.
Termination
By fkra|فكرة — we may suspend or terminate your access to the Platform for violations of these Terms or suspected malicious activity, and access tied to an organization's agreement ends when that agreement ends.
By you — you may close your account at any time by contacting us at support@fkra.ai; if your account is provisioned by your organization, contact its administrators.
Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitations of liability — survive.
Governing law and disputes
These Terms are governed by applicable law without regard to conflict-of-law principles. The parties will first attempt to resolve any dispute through good-faith negotiation; if it is not resolved within thirty (30) days, either party may pursue binding arbitration or the courts of competent jurisdiction, as permitted by applicable law.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision will be modified to the minimum extent necessary to make it valid while preserving its intent.
Entire agreement
These Terms, together with the Privacy Policy and any agreement between fkra|فكرة and your organization, constitute the entire agreement regarding your use of the Platform and supersede all prior understandings.
Changes to these terms
We may modify these Terms at any time. If we make material changes, we will post the updated Terms on this page and update the date above; for significant changes we may also notify you by email or through the Platform. Your continued use of fkra|فكرة after changes take effect constitutes acceptance of the revised Terms.
